Apartment developer argues with city of Phoenix about requirements, says it 'could kill this deal'

A development team is arguing that the comments of a city of Phoenix planner are more opinion than law, saying her stated requirements could derail plans for 384-unit apartment complex northwest of 59th Avenue and Elliot Road.

“Her comments could kill this deal for us, and I’m trying to get ahead of that,” said Mark Foster, vice president of development for the developer Hillpointe, during a city of Phoenix site plan meeting on Tuesday.

Planner Connie Brawders had extensive notes on the developer’s site plan for the 17.7-acre site, which received preliminary approval on Tuesday. The development team took issue with two.
