A federal lawsuit brought against the Department of Education is challenging the Biden Administration's rewrite of Title IX regulations. The landmark 50-year-old law prohibits education entities that receive federal funds from discriminating on the basis of sex.
Under the new regulations that had been set to take effect Aug. 1, the intentional misgendering or not using a student’s preferred pronouns can be considered sex discrimination. Also under the new rules, it can be considered sex discrimination to prohibit a person from using the restroom, locker room, or shower facility associated with the gender to which they identify. Previously, the law had not explicitly addressed this issue.
