Peoria man indicted in death of fellow IRS special agent

A Peoria man, who has served as a special agent for the Internal Revenue Service for more than 12 years, has been indicted for involuntary manslaughter in the shooting death of another IRS agent at a firearms range in Phoenix.

A federal grand jury in Tucson on Wednesday indicted Larry Edward Brown, Jr., 42, of Peoria in connection with the 2023 incident at the Federal Correctional Institution in Phoenix where special agent Patrick Bauer was fatally shot.

On Aug. 17, special IRS criminal investigation agents used the firearms range at correctional institution for standard pistol qualifications and classroom training, authorities said in a release.

Brown is a trained instructor in the use of force, according to the release from the U.S. Attorney’s Office.

“After all training had concluded for the day, Brown entered a building known as the ‘Tower,’ a small, one-room structure with an interior measuring approximately 8 feet by 9 feet, located on the range where firearms instructors can observe and command live-fire trainings,” the release stated.

The only other occupant inside the Tower was Bauer, a 15-year veteran of IRS-CI who also was a trained use of force instructor and had led the live-fire pistol qualifications on Aug 17.

The indictment alleges while inside the Tower, Brown “handled his firearm without due caution and with reckless disregard for human life, striking Special Agent Bauer in the torso with a single gunshot.”

Lifesaving efforts failed, and Bauer died from the injury.

Brown had his initial court appearance March 1 and has been released. The case has been set for trial on April 2.

Involuntary manslaughter of an officer of the United States carries a maximum penalty of eight years in prison and a fine of up to $250,000.

The FBI conducted the investigation with assistance from the Treasury Inspector General for Tax Administration. The U.S. Attorney’s Office for the District of Arizona, Tucson, is handling the prosecution.
