County board decides home can be built on small Peralta Estates lot near Apache Junction

Posted

A variance has been approved to reduce the minimum lot size requirements in a single residence zone for one parcel in the unincorporated area in the Peralta Estates Unit No. 2 subdivision just east of Apache Junction.

The Pinal County Board of Adjustment on Jan. 25 voted unanimously to approve the variance and to reduce the minimum lot area requirements to 20,000 square feet, or less than half an acre, from the acre requirement of 43,560 square feet for lot No. 46.

The variance will allow the applicant to obtain permits to build a single-family home on one undersized single-residence zoned property with applicable development standards, Case Coordinator Laree Mason wrote in a staff report.

The Peralta Estates subdivision was platted in 1961, creating the existing lot sizes. In 1962, the county introduced the CR-1 single-residence zone with a 20,000-square-foot (0.45-acre) minimum lot size. In 1983, the county introduced the CR-1A single-residence zone to replace the CR-1 zone, establishing the 43,560-square-foot (1 acre) minimum lot size, according to a county document.

A home and garage for a primary residence are to be constructed at the site, land owner Philip C. Karich of Florence wrote in an application for a variance of regulations in an unincorporated area of Pinal County.

“Our home plan is to retain as much of the natural beauty of the area and build a safe environment for our children,” he wrote.

The jurisdiction of the Board of Adjustment is throughout unincorporated portions of Pinal County. The board’s authority extends only to the interpretation of the zoning ordinance and to the granting of variances, according to the county’s website.
