Scottsdale preparing for legal fight over 2004 preserve tax

The City of Scottsdale has filed a motion in Maricopa County Superior Court to dismiss former councilman David Smith’s lawsuit to immediately stop collecting on a 0.15% sales tax earmarked for expansion and improvements to McDowell Sonoran Preserve that was passed by the voters in 2004.

But it also appears to be preparing for a fight at the same time.

The city council’s Nov. 10 meeting’s consent agenda includes an item putting Phoenix law firm Osborn Maledon on a $50,000 retainer in order to represent the city in court.
