Two adults and four underage teenagers were taken into custody on various charges ranging from felony flight and a minor in possession of a firearm to minors possessing or consuming alcohol, Monday morning.
The arrests are not in connection to a report of shots being fired near the intersection of Belleview Street and 70th Street around 1:40 a.m. on Oct. 20, according to a police report.
Upon arrival, no victims were located, no bullet strikes were found and no individuals reported being targeted or injured. The initial investigation revealed two separate locations away from the party residence where shell casings were located, according to the report.
While arriving at the area, patrol officers observed a vehicle leaving the vicinity and attempted a traffic stop near Scottsdale and McDowell roads. The vehicle failed to yield, and a pursuit was initiated but was terminated by patrol when the vehicle merged onto the freeway. The Arizona Department of Public Safety was notified and assumed surveillance of the vehicle. It was later confirmed that Arizona Department of Public Safety maintained continuous visual contact and was able to get the vehicle stopped, according to the report.
Patrol officers responded to the location of the stop. The vehicle contained two adults and four juveniles.
Simultaneously, officers investigating the shots fired call located a nearby party approximately 100 yards from the reported shooting location, the report said. Partygoers were contacted and denied any involvement, the report said. Officers found no evidence at the scene to suggest a shooting had occurred at the house party, the report said. There is no available information that confirms the house the party was at is a short-term rental.
A search of the vehicle revealed an empty handgun and an empty magazine located in the trunk, concealed in the spare tire compartment beneath miscellaneous items. No ammunition or shell casings were found. All occupants denied involvement in any shooting.
A 15-year-old juvenile boy claimed sole ownership of the firearm and stated it had not been used in any criminal activity, the report said.
After consultation with investigators, patrol officers determined that, based on the timeline of events and continuous Arizona Department of Public Safety surveillance, there was lack of evidence linking the stopped vehicle or the recovered firearm to the reported shooting on 70th Street, the report said.
The driver of the vehicle was arrested for felony flight from law enforcement. The passengers were cited for various liquor-related offenses. The 15-year-old who claimed ownership of the firearm was arrested for unlawful possession of a firearm by a minor.
All charges related to the six arrestees stem from the traffic stop, not from the shooting or the house party.
Those arrested and booked into the Scottsdale City Jail are:
•Benjamin Brown, 21, was booked for felony flight, reckless driving, aggressive driving and driving on a suspended driver’s license.
•Iolana Hernandez, 18, was booked for criminal littering.
•A 15-year-old boy was booked for minor in possession of a firearm.
•Two teenage girls and one teenage boy were all boocked for disorderly conduct and minor in possession or consuming alcohol.
