Victor Xitez’s letter (“Wake up Sun City residents,” Sun City Independent, Nov. 23, 2022) was a spot on informative opinion.
It was regarding a massively oversized back yard building under construction at 9302 W. Manzanita Drive and the Sun City HOA’s failure to enforce the CC&Rs. The truth is, the Sun City HOA can not enforce any of the tough sounding CC&Rs that all property owners believe to be enforceable. Otherwise, Sun City would not have permanent underaged residents openly violating the age restrictions or the massive construction violation at 9302 W. Manzanita Drive.
Sun City Home Owners Association Board Resolution (May 5, 2011) paragraph five states, “1) A detached garage must be of standard size for passenger vehicles. 2) Motor homes and RVs are not considered passenger vehicles. 3) The roof line must not exceed the height of the residence.”
This massive building at 9302 W. Manzanita Drive violates all three at the same time. Yet, the HOA claims there is nothing they will do about it even though a clearly written Sun City CC&R board resolution disallows it.
I know the SCHOA board is a group of well intended volunteers using their own time to provide some form of leadership. Many thanks to them. But the truth is, the HOA board refuses to enforce the CC&Rs because a violator might become cranky and throw a fit. It seems the Sun City CC&Rs, the bylaws and the board resolutions are actually unenforceable hollow illusions without meaning. This gives every CC&R violator permission to do anything they want. And not one board member says a word. That’s the most disappointing part for Sun City CR&R complying property owners to learn after investing in a retirement community believing the HOA will actually protect property owners by actually enforcing rules. It’s all an illusion and these CC&R violators know how to exploit that weakness.
All of this combined is the piece by piece slow burn destruction that will eliminate Sun City as a retirement community. It is happening right now in front of us. And we are helpless to stop it because the CC&Rs will not be enforced. I’m not sure where to turn or who to talk to about effective Sun City CC&R enforcement to protect property owners. It is clearly not the HOA or compliance office.
