Reilly: Golf courses are private property

Mr. Andrew Sullivan wrote in a letter, (“5 simple rules to allow golf course use,” Sun City West Independent, June 29, 2022), “I have always felt common sense would easily prevail regarding non-golf use on our courses after hours.”

Mr. Sullivan, if you had any common sense you would have read the CC&Rs when you purchased your property 22 years ago. I read the CC&Rs 28 years ago! Golf course property is not owned by the homeowners, it’s private property. It would appear that perhaps you are just another scofflaw.

Your rules are irrelevant. You state, “Golf course equipment is not to be touched (sprinklers, bunkers takes etc...).” Would that include walking on the property? Golf course property is private property, not a park. Simply read the signs posted on the golf course property, “No Pets, No Trespassing.” Homeowners that purchased golf course property paid a premium for their golf course lots, not a park.

I understand that many homeowners in Sun City West chose not to purchase golf course lots. However, that doesn’t give them the right to trespass. Many days and nights we’ve had trespassers in our backyard adjacent to the golf course. We purchased golf course property with the understanding that only paying golfers are allowed on the course during regular golfing hours.

From my research, it appears you do not live on the golf course. Apparently, you have no idea what it’s like to be awakened in the late hours of the evening by trespassers. You also wrote, ”Sun City West, handle the necessary insurance wording. It’s no difference than any park-oriented insurance policy.” It is not a park! And it will never become a park as per our deeds!
