Motion to show cause filed in lawsuit over sunsetting 2004 parks and preserve tax early

The City of Scottsdale has not yet responded to a lawsuit by former Scottsdale City Councilman and City Treasurer David Smith to sunset the parks and preserves sales tax passed in 2004 early.

That means Smith has filed a motion to show cause in Maricopa County Superior Court Judge Daniel Martin’s court to force the city to either respond to the suit or explain why it does not need to.

“I do not know what their thinking was,” Smith said. “As I said, they did not choose to talk to me or my attorney or, as far as I know, the court, so I took the next step.”
