A 36-year-old fugitive who crashed his vehicle through the front of a cell phone store last month to elude Mesa police has been charged on variety of counts, including aggravated assault and criminal damage, authorities said Friday.

Kevin McKinney, who has a warrant out of Colorado and a warrant for homicide out of New Mexico, recently was released from a hospital following the Aug. 21 incident and booked into jail, Mesa police said.

Mesa officers were attempting to arrest McKinney on those out-of-state warrants on the afternoon of Sunday, Aug. 21, after they received information he was at the store, 1960 W. Baseline Road.

Police said he appeared to be purchasing a phone.

He left the store and got into his vehicle.

“When McKinney entered his vehicle, police officers, using red/blue flashing lights and wearing uniforms that stated ‘Police’ on them, attempted to take McKinney into custody.”

A police car pulled behind McKinney’s vehicle with its bumper touching the rear of the suspect’s vehicle.

“In an attempt to escape, McKinney drove over the curb and onto the sidewalk in front of the business,” documents released by police stated.

“McKinney's vehicle then drove through the front window of the business, crashing through wall and window, sending glass and debris throughout.”

A customer in the store felt in danger from the car crashing into the building, police said.

An officer shot at and hit McKinney as he was crashing through the front of the store, according to the documents

“McKinney was the only occupant in the vehicle. In plain view near the passenger seat of McKinney's vehicle, was a revolver. During a search warrant of the vehicle the revolver was recovered. The revolver was fully loaded and the hammer was positioned in the ‘cocked’ position. The serial number on the revolver has been obliterated.”

Police said McKinney admitted to driving into the business to try and escape and admitted he is a convicted felon and has not had his rights restored to possess firearms.

The owner of the business estimates the cost to repair the window, frame and wall at $15,000, police said.
