Man sentenced to 20 years in prison after shooting at police

A Phoenix man was sentenced was sentenced to 20 years in prison Friday for shooting at police, the Maricopa County Attorney’s office announced in a release.

Eberto Hernandez, 40, committed multiple felony offenses, including two counts of aggravated assault on a police offer, one count of aggravated assault, one count of unlawful discharge of a firearm, and three counts of disorderly conduct, according to the release.

Hernandez also received an additional 2.5 years in prison for violating his probation, a sentence that will run consecutively to the 20-year sentence.

Man sentenced to 20 years in prison after shooting at police

A Phoenix man was sentenced was sentenced to 20 years in prison Friday for shooting at police, the Maricopa County Attorney’s office announced in a release.

Eberto Hernandez, 40, committed multiple felony offenses, including two counts of aggravated assault on a police offer, one count of aggravated assault, one count of unlawful discharge of a firearm, and three counts of disorderly conduct, according to the release.

Hernandez also received an additional 2.5 years in prison for violating his probation, a sentence that will run consecutively to the 20-year sentence.

In May 2023, Phoenix Police officers went to Hernandez’s home to follow up on a report of possible shots fired earlier in the day, according to the release.

As officers arrived, Hernandez, a prohibited possessor, was armed with a handgun and laying on a couch just inside the front door.  Officers rang the doorbell, and as Hernandez’s mother answered the door, Hernandez got up and fired multiple rounds into the couch before retreating further inside the residence, according to the release.

Hernandez then proceeded to fire multiple additional rounds inside the house, including several toward his mother as she tried to disarm him. Officers positioned themselves outside the home and were also targeted.  His mother was ultimately able to get the gun away from him after he had fired over 20 rounds inside the residence. Hernandez later surrendered, according to the release.

“Mr. Hernandez turned a neighborhood call for help into a life-threatening situation for his own family and our police officers,” said County Attorney Rachel Mitchell in the release.. “This sentence sends a clear message: when you endanger others with a firearm, especially as a prohibited possessor, you will be held fully accountable.”
