Lawsuit to block Scottsdale parks funding ballot measure fails

Protect and Preserve tax question can stay on ballot, but opponents promise an appeal

The City of Scottsdale’s ballot measure to create a sales tax to pay for maintenance, personnel and capital improvements at the McDowell Sonoran Preserve, the city’s 44 parks and WestWorld can remain on the ballot, at least for now.

The Goldwater Institute sued the city in Maricopa County Superior Court to keep the question off the ballot, claiming the ballot language was misleading because it says a yes vote would be a tax reduction without mentioning that a no vote would be an even greater tax reduction.
Judge Michael D. Gordon ruled in the city’s favor July 19.
