Lawsuit filed to sunset Scottsdale's 2004 parks and preserve tax early

Some fear former Scottsdale City Councilman David Smith’s lawsuit to sunset the 2024 parks and preserve tax early, will eliminate funding for a land bridge for wildlife over Rio Verde Drive.

Former Scottsdale City Councilman and city treasurer David Smith has filed a lawsuit against the city in an attempt to sunset the parks and preserves sales tax passed in 2004 early.

Smith said it is not needed anymore and is simply collecting money that cannot legally be spent.

Mayor Lisa Borowsky said she didn’t think the city can legally do what the Smith is asking for and added she thinks the suit won’t go to court.
