A Gilbert resident's ethics complaint accusing council members Jim Torgeson and Chuck Bongiovanni of retaliating against her by using a police report in a political attack has stalled after town officials determined she cannot initiate a Code of Conduct complaint under the town's policy.
Town Clerk Chaveli Herrera informed Mindy Brocker in a June 29 email that Gilbert's Code of Conduct allows complaints to be filed only by elected or appointed public officials or town staff.
Herrera said Brocker's complaint had been shared with the town council and that it would be up to a council member to pursue it if one believed the allegations warranted review.
