First Amendment groups want court to throw out case filed by Peoria Unified member against her own board

Groups say Rooks has ‘no actual case’

Two First Amendment advocacy groups are asking a federal district court to throw out a case that a Peoria Unified School District governing board member filed against her own school board.

Last week, the Freedom From Religion Foundation and Secular AZ filed an amicus brief asking the U.S. District Court of Arizona to dismiss a case governing board member Heather Rooks filed last September alleging the school district infringed on her right to quote Biblical scripture during public meetings.

FFRF and Secular AZ’s brief is asking the court to dismiss the case because they contend Rooks has no actual case or controversy to adjudicate.
