Fired Apache Junction firefighter’s appeal before tribunal postponed to Feb. 4

A nearly 25-year employee of the Superstition Fire and Medical District who is appealing his termination from employment before a state agency did not have a scheduled hearing in December as it was postponed to a status update meeting in February.

Brian White, who until earlier this year was a battalion chief, was fired as of March 13.

White appealed the decision for termination of employment and attorneys filed a request March 22 for a hearing before the Arizona Office of Administrative Hearings.

Fired Apache Junction firefighter’s appeal before tribunal postponed to Feb. 4

A nearly 25-year employee of the Superstition Fire and Medical District who is appealing his termination from employment before a state agency did not have a scheduled hearing in December as it was postponed to a status update meeting in February.

Brian White, who until earlier this year was a battalion chief, was fired as of March 13.

White appealed the decision for termination of employment and attorneys filed a request March 22 for a hearing before the Arizona Office of Administrative Hearings.

The hearing in the matter of Brian White, appellant, vs. Superstition Fire and Medical District, respondent, was to be Sept. 20-24 on video conferencing Google Meet. It was postponed and a status update was set for Nov. 19, according to a Sept. 15 minute entry granting continuance signed by Jenna Clark, administrative law judge of the Arizona Office of Administrative Hearings.

The Nov. 19 status hearing was postponed to Dec. 20 and then to Feb. 4, according to a minute entry granting continuance signed by Clark.

“Good cause appearing, the hearing in the above-entitled matter is continued and set for a status update on Friday, Feb. 4. On or before this date the parties shall submit one of the following stipulated motions to the office of administrative hearings: (1) inform the tribunal that the matter has been satisfactorily resolved by submitting a motion to vacate the hearing, or (2) inform the tribunal that the parties are unable to resolve their dispute and request that the matter be set for hearing. No additional continuances shall be granted in the above-captioned matter absent a prima facie showing of exigency,” it states.

The Superstition Fire and Medical District provides fire suppression, fire prevention, wildland protection, advanced life support, rescue, extrication and medical transportation services out of five fire stations in Apache Junction and Gold Canyon. Under the SFMD governing board’s direction, the district has a budget of $23.7 million through four divisions: emergency services operations, which includes transport; planning and logistics; administrative services; and financial services.
