Bystander, suspect shot by Chandler Police

Tuesday, Chandler Police provided some information about a Sunday evening incident in which an officer shot both a suspect and an apparent bystander.

In a news release late Tuesday, police said both Luciano Gutierrez, 59, of Chandler, and a 33-year-old  Chandler man were both in stable condition at an area hospital.  The release states both were shot by an officer who was investigating an incident near North Country Club Way and West Carla Vista Drive. 

Sunday, just after 6 p.m., police said, officers responded to a call for service involving a person, later identified as Gutierrez, armed with a gun.

When officers arrived, they spotted Guttierrez, with a gun, standing inside a doorway, the release states. Officers positioned and commanded Gutierrez to surrender but he did not comply.   

Officers then observed another man to the east of the property, walking around, within the established police perimeter. The man was given commands to return to his residence for his own safety, police said, but he, too, refused to comply.  

Police said Gutierrez then exited the residence and raised his weapon in the direction of the officers, prompting officers to fire and hit him.

While that shooting was happening, an officer with a different vantage point saw the bystander man on the street. Police said the man, at one point, made movements "indicative of a person armed with a weapon" and was pointing toward officers. The officer fired one shot, striking and injuring the man.

That person was later identified to be a neighbor and the same man who initially refused to obey the officer’s commands to go back inside his residence, police said.   

The release states officers rendered medical aid to both men, who were transported to a local hospital, 

The neighbor is a 33-year-old man. Police stated  Tuesday they are not releasing his identity "right now."

Chandler Police said the officers involved in the incident were a sergeant with nine years of service and two officers who each had five years of service.

All three were placed on administrative leave, per procedure, pending the outcome of an internal and criminal investigation conducted in conjunction with the Maricopa County Attorney’s Office.

The release states no one else was injured in the incident, including the three officers.
