The Maricopa County Board of Supervisors unanimously approved a resolution Wednesday for procedures for the 2026 primary election despite receiving a letter at the 11th hour from the attorney representing County Recorder Justin Heap.
The board received a letter moments prior to the meeting from Heap’s attorney James Rogers, saying that board members, and those who volunteer with elections ballot boxes, could face felony charges if Heap’s wishes are not met.
The letter stems from the board’s previous action during its May 6 meeting when supervisors voted to appeal a judge’s decision giving Heap complete control over the election.
