PHOENIX - A federal appeals court late Friday gave the state prison system partial reprieve in its bid to keep its health system from being taken over by a court-appointed receiver.
In a brief order, the 9th Circuit Court of Appeals acknowledged that the lawsuit against the Department of Corrections, Rehabilitation, and Reentry has been going on since 2012. And the appellate court said the state has not complied with even a 2023 injunction issued by U.S. District Court Judge Roslyn Silver.
But the court, in the unsigned order, also said that the state is raising "serious questions'' about the authority of a federal judge to take over health care in a prison system.
