Arizona Attorney General sues Tolleson over firefighter’s ‘exit penalty’

Arizona Attorney General Kris Mayes filed a lawsuit in Maricopa County Superior Court against the City of Tolleson over firefighter “exit penalties,” according to a Tuesday news release from the Attorney General’s Office.

The lawsuit challenges a city policy that requires newly hired entry-level firefighters to pay the city $15,000 if they leave within three years.

Tolleson requires new firefighters, as a condition of employment, to sign what the lawsuit calls the Firefighter Training Repayment Agreement Provisions, or “TRAP.” The agreement demands a flat $15,000 from any firefighter who leaves within three years of being hired, whether the firefighter served three weeks or nearly three years.
