The father of a 3-year-old girl suspected of shooting her May 1 at a home in Surprise has been charged with homicide after the girl died from her injuries, police said Monday.

The Surprise Police Department is working with the Maricopa County Attorney’s Office Dariusz Modrzejewski to amend charges to include homicide, police said. He is being held on $1 million bond.

On May 1, just after 6:30 p.m., Surprise Police and Fire-Medical personnel responded to a home near of 184th Drive and West Bell Road after neighbors reported a man acting erratically.

The man, Modrzejewski, 48, then called 9-1-1 and “made threatening statements about harming his family,” according to a Surprise Police Department release.

“Surprise Police Crisis Negotiators supported by the SWAT team worked for a peaceful resolution while also setting up a perimeter around the home. When officers heard a gunshot from inside the home, they immediately forced entry and found a three-year-old girl with a gunshot wound.

"The team quickly rushed to an ambulance that was staged nearby, and Modrzejewski was taken into custody without further incident.”

Modrzejewski initially was booked into the Maricopa County Jail on three aggravated assault charges.
