Cave Creek Council set for final approval of rezoning of open space

Posted

The Cave Creek Town Council is set to give final approval to five plots of land to change its zoning to open space conservation at Tuesday night’s council meeting.

The five plots of land received first approval at the Oct. 6 meeting, and require a second reading and final approval on Tuesday.

Over the years, there have been a handful of properties which the Town has acquired or has  dedicated for the purpose of open space.

On some of these properties, the zoning was never changed to accurately reflect the intended utilization of these lands. In many of these instances, the zoning of these properties is in the form of residential, but the lands are not intended to be developed; rather to be added to the Town’s inventory of public open space.

In order to rezone a property, it must conform with the adopted General Plan. Two of these properties require a General Plan Amendment in addition to rezoning. Additionally, Desert Foothills Land Trust owns a few properties in Town which are preserved for open space in which the Zoning and/or General Plan Land Use Designations do not match the intended use.

There is a 30-day period for public referendum prior to the ordinances to become official.

The council will also be considering the acceptance of an non-motorized trail easement near Spur Cross Road.

When the trail was initially installed over 20 years ago, the contractor routed the trail around vegetation within the shoulder of right-of-way which, subsequent survey has shown, places a portion of the trail on the property of a Cave Creek resident.

The owner has worked with staff to dedicate a non-motorized trail easement where the as-built location of the trail is currently.

The council will also hear quarterly presentations from the Daisy Mountain Fire Department, the Engineering/Public Works Department and the Development Services Department.
