Martin: Executive session being abused in Sun City

Posted

Executive session was developed for the purpose of being able to provide proprietary information to the board.

That includes things that could cause issues if the information was provided in a public meeting.

There are very specific requirements for notice, including the fact that the individual being discussed must be given notice and can request the meeting be a public meeting. In the case of the Recreation Centers of Sun City board meeting in executive session to terminate Karen McAdam’s service, this requirement was not met, nor was proper notice provided to the public.

Plus, you cannot take action in executive session, ARS 38-431.03 Executive Sessions. It is a law. You cannot circumvent a law with a rule, the law prevails.

Therefore, I believe this action should be declared void as it was not appropriately managed.
