Scali: Clarifications to Paradise Valley hillside code update article

According to the quotes in the Hillside Code article, “Mr. Tonn denied being part of any lawsuit against Mr. Scali, calling his accusations unfortunate and a means to further enhance his personal agenda.” However, Mr. Tonn is not being honest.

Mr. Tonn together with his neighbors did form an LLC at 3/28/16 with the stated purpose in a 2016 email written by Mr. Tonn to his neighbors: “Do know we are dedicated to stop this development and hopefully, separately, secure the TMS lot (owned by Scali) and put it in trust”. And, Mr. Tonn and Julie Pace did organize a group to gang up on the TMS development and denied physical access to my property.

In fact, even as of now, Mr. Tonn acts as a manager of that LLC and the funds have been used to finance the lawsuits to stop the TMS development and to diminish the value, usability and the opportunity to build on my property. So, Mr. Tonn is incapable of acting honestly as a Hillside Committee resident representative.

He is conflicted and his intentions are clear. Thus far, the losing legal actions that Mr. Tonn’s LLC funded have cost over $1 million for his neighbors and they stand to lose several hundred thousand dollars more in the current appeal lawsuit.

Mr. Tonn’s 2016 email also stated “...after reviewing legal positions with various attorneys, have very strong belief we can stop the development through legal channels.” I am supposed to believe that Mr. Tonn and his next door neighbor, Ms. Pace, are without conflict in their plans to stop me from building my home on my property?

I also stated that Mr. Tonn met with me, threatened me that he was part of a powerful group and that they would never allow me to build on the TMS property.

According to the article, Mr. Tonn admits the meeting but claims the threats never occurred. And, yet during the ensuing period of 2016 Mr. Tonn and Ms. Pace organize said group and create a legal fund and fund an initial lawsuit and now fund an appeal of their loss.

I believe now that Mr. Tonn’s false statements are defaming and libelous. His emails and actions don’t support his false statements.

To conclude, Mr. Tonn and Ms. Pace are conflicted in their goals to change Hillside Code as they wish and have conspired to diminish the value and opportunity for me to build my home.

Both Mr. Tonn and Julie Pace now misuse their political positions and power within the council and committee to damage my property value.

They have structured code changes that would allow for unlimited charge back to this lot applicant’s building costs.

So, neither should be allowed by the town government to be involved in Hillside Code structure given their stated personal conflicts and involvements --- intended to stop the development and get the lot!

The lot owners in Paradise Valley deserve fair and reasonable representation and solutions (from people without conflicts and gang objectives) for building our homes.
