Matter before AZ Office of Administrative Hearings topic of SFMD board executive session

The Superstition Fire and Medical District board may meet Wednesday in a closed-door executive session to discuss a consulting agreement with retired Fire Chief Mike Farber and also a personnel matter to be heard by the Arizona Office of Administrative Hearings.

The board meets at 5:30 p.m. June 16 at the administration office, 565 N. Idaho Road in Apache Junction. The meeting is open to the public or by phone conference at 480-646-1864 pin 1234.

As the 10th item on the agenda, the board may vote to go into executive session “for legal advice pursuant to §A.R.S. 38- 431.03(A)(3) in regard to the possible 1099 consulting agreement with retired Fire Chief Mike Farber; and possible instructions to legal counsel pursuant to §A.R.S. 38-431.03(A)(4) relating thereto” and “for legal advice pursuant to §A.R.S. 38- 431.03(A)(3) and possible instructions to legal counsel pursuant to §A.R.S. 38-431.03(A)(4) re: the pending White personnel matter; and related Office of Administrative Hearing(s) matter relating thereto.”

Following the confidential executive session, the board is slated to hold a public session with discussion and possible direction regarding the “possible approval of a 1099 consulting agreement with retired Fire Chief Mike Farber; possible instructions to legal counsel and staff relating to the same” and “discussion and possible action re: the White personnel matter; and related pending Office of Administrative Hearing(s) matter; possible instructions to legal counsel and staff relating to the same,” according to the agenda.

Regarding an area of law described as an appealable agency action, hearings are planned 9 a.m. June 23-24 on the matter of Brian White vs. Superstition Fire and Medical District, according to the website of the Arizona Office of Administrative Hearings. Party stipulations must be submitted to a tribunal June 23 and closing arguments are scheduled to be heard on the record June 24, according to azoah.com.

The fire district provides fire suppression, fire prevention, wildland protection, advanced life support, rescue, extrication and medical transportation services out of five fire stations: Fire Station 261, 1135 W Superstition Blvd. in Apache Junction; Fire Station 262, 3955 E. Superstition Blvd. in Apache Junction; Fire Station 263, 1645 S. Idaho Road in Apache Junction; Fire Station 264, 7557 E. U.S. Highway 60 in Gold Canyon; and Fire Station 265, 9294 E. Don Donnelly Trail in Gold Canyon.
